These articles, introduced on Wednesday, criticize Mayorkas for neglecting his duty to safeguard the nation and uphold the Constitution, while engaging in actions deemed incompatible with United States laws.

Furthermore, Greene’s articles assert that his implementation of “catch-and-release” policies has allowed migrants to enter the country without a robust enforcement mechanism in place to ensure proper processing through the U.S. court system.
Republican calls for Mayorkas’ impeachment have gained momentum in recent weeks, particularly as the expiration of Title 42 drew near. GOP senators, including Roger Marshall of Kansas, Ted Cruz of Texas, Ted Budd of North Carolina, and John Hoeven of North Dakota, have advocated for his removal based on the humanitarian crisis they observed during their visit to the border in Brownsville, Texas.

The impeachment articles argue that Mayorkas is complicit in the termination of Title 42, which has not only endangered American citizens but also created significant challenges for border patrol agents in managing the influx of migrants. Title 42 was implemented in 2020 under the previous administration as a response to the pandemic, enabling the swift removal of individuals who illegally crossed into the country.
During their visit, Senator Marshall described the situation at the border as an absolute disaster and humanitarian crisis, emphasizing that it poses the primary national security threat to the United States from southern Texas to Arizona. Prior to the expiration of Title 42, border apprehensions were reaching approximately 10,000 per day. However, following its termination, the number of crossings decreased by around 50 percent as migrants and the smugglers exploiting their circumstances assessed the new regulatory framework under Title 8.

President Biden expressed satisfaction with the recent decline in border crossings, stating that his hope is for these numbers to continue decreasing, while acknowledging that there is still much work to be done. Since Biden assumed office, over 6 million individuals have entered the United States unlawfully, including 1.4 million who were able to evade law enforcement apprehension.
This is not the first time that impeachment articles have been filed against Secretary Mayorkas. In 2021, Congressman Andy Biggs of Arizona initiated the first impeachment effort, although it did not progress due to the Democratic majority in the House at that time. In early 2023, following the Republican takeover of the House, Congressman Pat Fallon of Texas introduced similar legislation, citing Mayorkas’s disparagement of border patrol agents during the “whipgate” controversy as one of the significant reasons for removing him from his position.
Despite being referred to House Judiciary Chairman Jim Jordan, these articles were not advanced for a broader vote in the House of Representatives.
